Agreement
These Terms of Service ("Terms") are between you and Everfondly LLC, a Wyoming limited liability company with a mailing office at 30 N Gould St Ste N, Sheridan, WY 82801, United States.
By accessing our website, using our services, or placing an order, you agree to these Terms and the policies referenced in them.
You must be at least 18 years old, or have the permission of a parent or legal guardian, to place an order.
Our products
Everfondly sells personalized products as well as, where offered, ready-made products.
A personalized product is any product created specifically using information supplied for an individual order, including a photograph, name, date, quote, message, engraving, selected personalization option, or similar content.
A ready-made product is sold without customer-specific personalization.
Different cancellation, return, and refund rules apply to personalized and ready-made products. Please review our Return & Refund Policy before ordering.
Orders and acceptance
Submitting an order is an offer to purchase the products in that order.
We reserve the right to decline or cancel an order before production and issue an appropriate refund when reasonably necessary, including if:
- a product is unavailable;
- there is a material pricing or product-description error;
- the personalization content cannot reasonably or technically be produced;
- the submitted photo cannot reasonably be used and a suitable replacement is unavailable;
- we reasonably believe the personalization violates law or third-party rights; or
- we reasonably suspect a fraudulent or abusive transaction.
Pricing and payment
Unless otherwise stated, prices displayed on our store are in U.S. dollars.
Prices and promotions may change from time to time. A later price change does not affect an order that has already been accepted at the price paid.
Discount codes cannot be combined unless we expressly state otherwise and generally cannot be applied retroactively after an order has been completed.
Your photographs and personalization content
For personalized products, you may submit photographs, names, dates, quotes, messages, engraving text, and other instructions.
By submitting content to Everfondly, you confirm that you own that content or have permission to use it for the requested product, and that our use of it to create and fulfill your order does not knowingly infringe another person's copyright, trademark, privacy, publicity, or other applicable rights.
You give Everfondly and the service providers involved in fulfilling your order a limited permission to reproduce, process, transmit, modify, format, and use your submitted content only as reasonably necessary to:
- prepare your personalized design;
- create and send your product preview where requested;
- produce and fulfill your order;
- provide shipping and customer support;
- handle revisions, replacements, refunds, or disputes; and
- comply with applicable legal obligations.
Your original photograph and other original content that you submit remain yours.
We do not use customer photographs submitted for personalization in advertising, social media posts, or public promotional materials without separate permission.
Content we may decline
We may decline to reproduce personalization content that we reasonably believe is unlawful, threatening, hateful, obscene, abusive, fraudulent, or infringes another person's rights.
If we decline a personalized order for this reason before production begins, we will cancel the affected order and issue an appropriate refund.
Product previews
For personalized products that offer a preview option, you may choose either:
- Preview before production; or
- Skip Preview.
Preview before production
If you choose a preview, we normally send a product preview to the email address you provide within 1–2 business days after receiving the usable information needed to prepare it.
Nothing is printed until you approve your final preview.
Your order includes up to two rounds of free preview revisions. A revision round means one consolidated set of requested changes submitted at one time.
After the two included rounds, Everfondly may make a small additional adjustment as a courtesy when the change is minor and reasonable. This is not a promise of unlimited revisions.
Whenever we modify a preview after your last approval, the updated final preview must be approved before production.
The preview is not a digital product
The preview is supplied solely so that you can review your personalized physical product before production.
Your purchase does not include a standalone digital artwork file, high-resolution artwork, editable source file, print-ready file, or commercial license unless a product page expressly says otherwise.
If we do not hear from you
If you choose a preview and do not respond, we do not treat your silence as approval.
We normally follow up on day 2, day 4, and day 7 after the preview is sent.
If we still have not received your approval 14 days after sending the preview, we will cancel the order and refund it in full.
Skip Preview
If you choose Skip Preview, you authorize us to create your personalized piece using the photo, text, selections, and instructions you submitted without waiting for a separate preview approval.
Skip-preview orders do not include preview revisions and may enter production shortly after we have the usable information needed to make the order.
Cancellation and production
For an order with a preview, you may cancel for a full refund at any time before approving the final preview.
For preview orders, production begins when you approve the final preview. At that point, we release the approved order to our production partner for manufacturing.
Because personalized products are made specifically for the customer and cannot reasonably be resold, personalized orders become final sale for change of mind once production begins.
For Skip Preview orders, production may begin shortly after the usable personalization information is received. If you need to cancel, contact us immediately. We cannot guarantee cancellation after the order has been submitted for production.
Accuracy of the information you submit
If you choose a preview, please check the final preview carefully before approving it, including:
- the photograph;
- names and spelling;
- dates;
- quotes and messages;
- engraving text;
- layout and placement; and
- selected product options.
We produce the item based on the final preview you approve.
If you choose Skip Preview, please check the same information before submitting the order because we produce the item using the information you provide.
Once production begins, Everfondly is not responsible for errors originating in customer-supplied information, such as an incorrect spelling, date, message, photograph, address, or personalization choice.
Errors made by Everfondly remain covered by our Return & Refund Policy.
Product appearance and reasonable variations
Digital screens display colors and brightness differently, and a physical product may not look identical under every lighting condition.
Natural materials such as wood may vary in grain, tone, pattern, and appearance.
Printing, acrylic cutting, assembly, and other production processes may also create small variations between product photographs, previews, and the finished item.
Reasonable minor variations are not considered defects.
A personalized product that is materially different from the final preview you approved, or from the personalization information you submitted if you skipped the preview, remains covered by our Return & Refund Policy.
Shipping and delivery
Our Shipping Policy explains our estimated delivery windows, shipping destinations, tracking process, address issues, delays, lost shipments, and related matters.
The Shipping Policy forms part of these Terms.
Delivery dates are estimates unless we expressly state that a particular date is guaranteed.
If we cannot ship within a timeframe we have promised or otherwise required by applicable law, we will provide the notice and options required under the circumstances.
Website and product content
Except for customer content submitted by customers, the website and its original branding, product photography, graphics, written content, layouts, design elements, and other materials are owned by Everfondly LLC, its licensors, or their respective owners to the extent protected by applicable law.
You may not copy, reproduce, distribute, or commercially exploit those materials without permission except as allowed by applicable law.
Purchasing a personalized physical product gives you the physical product you ordered. It does not automatically transfer editable files, production files, source files, standalone digital artwork, or commercial-use rights.
Third-party service providers
We use third-party service providers for functions such as website hosting, payment processing, product personalization and file uploads, artwork or image processing, production, fulfillment, analytics, customer support, and shipping.
These providers may process information necessary to perform their role in providing our services.
Our use of third-party providers does not remove any responsibility Everfondly has to you under these Terms or applicable law.
Fraud and abuse
We aim to resolve genuine customer problems fairly and quickly.
We may also take reasonable steps to verify claims, order ownership, delivery information, or product issues when necessary to prevent fraud or abuse.
Providing false information, submitting fraudulent claims, intentionally misrepresenting delivery or product condition, abusing promotions, or otherwise attempting to obtain goods or refunds dishonestly may result in an order being declined or further service being refused where permitted by law.
Nothing in this section reduces the rights of customers making genuine claims.
Limitation of liability
To the maximum extent permitted by applicable law, Everfondly is not responsible for indirect, incidental, special, or consequential losses arising from an order, including losses resulting from an item not arriving in time for a particular event when the stated delivery date was an estimate rather than a guaranteed date.
To the maximum extent permitted by applicable law, Everfondly's aggregate liability arising directly from a particular order will not exceed the amount paid for that order.
Nothing in these Terms excludes, restricts, or limits liability or consumer rights that cannot legally be excluded, restricted, or limited.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles, except to the extent mandatory consumer protection laws applicable to you provide otherwise.
To the extent permitted by applicable law, disputes relating to these Terms or an order may be brought in an appropriate state or federal court located in Wyoming.
Nothing in this section prevents a customer from bringing a claim in another court, forum, or jurisdiction where applicable law gives that customer the right to do so.
Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
Changes to these Terms
We may update these Terms from time to time.
For an individual purchase, the version of these Terms in effect when the applicable order was placed will generally apply to that order, subject to applicable law.
